State Senator R.C. Soles Jr. wounded a former client Sunday afternoon at the lawmaker�s Tabor City home during an attempted break-in of the residence, according to sheriff�s reports.

Thomas Kyle Blackburn of Tabor City, released from prison in June 2008 after serving a term of 16 to 20 months for a list of crimes, was struck in a thigh by a bullet, and hospitalized in the Loris Community Hospital in Loris, S.C.

The 22-year-old Blackburn was accompanied by Billie Jay �B.J.� Wright, 23, of Tabor City � who was released from prison Aug. 10 � when they went to Soles� residence, which is just outside the Tabor City town limits.

SBI investigating


The State Bureau of Investigation (SBI) is handling the case, and there has been no word from the agency or state Attorney General Roy Cooper�s office except that the SBI is investigating the incident.

No charges had been filed as of 10 a.m. today.

Blackburn was placed in a private room under guard in the Loris hospital, and family members were asked to leave, because of safety and people control issues, it was reported.

It was not clear Monday (today) how Blackburn was taken to the hospital, but it was reported that he was taken by Wright after the shooting that took place at 5:20 p.m.

Several detectives

Five SBI agents, Tabor City Police Chief Donald Dowless, his two detectives, and two detectives from Sheriff Chris Batten�s staff were at the residence for a minimum of four hours Sunday night.

The first SBI agent to arrive was Mac Warner, assistant agent in charge of the SBI�s Coastal District. He arrived at 6:17 p.m. Three other agents arrived within an hour, and a fourth went to Soles� home shortly after 8 p.m.

The shooting is the first reported act involving weapons in confrontations, trespassing and threat cases between Soles and several of his former and current clients in criminal cases during the past three years, according to reports from Tabor City police.

2nd SBI probe

Soles, who marks his 75th birthday in December, is the subject of an SBI probe concerning sexual allegations by another former client, Stacey Osteen Scott � a charge that was entirely recanted by Scott in interviews with several media outlets last week, including The News Reporter.

Blackburn was released from prison June 21, 2008 after serving a term that began Sept. 19, 2005 for breaking and entering, and larceny, fraud, and a laundry list of 2006 misdemeanor charges. The prison term was shortened by months of jail time Blackburn served before he was sent to the state system.

Blackburn�s first run-in with the law, according to court and Department of Correction records, was when he broke into a neighbor�s home along F.M. Stanley Road, Clarendon, on Oct. 31, 2004.

Weapons, cash

Records show he stole a pistol, shotgun, nine rings and cash owned by Robert Beck. Blackburn pleaded in September 2005, and was placed on probation for two years, with a prison term of six to eight months suspended.

Blackburn was arrested in February 2006 on a misdemeanor breaking and entering case. He was charged with felony breaking and entering, and larceny for a July 3, 2006 case where Ryan Larry Cartrette�s storage building along Lebanon Church Road was broken into, and a grass trimmer and other items were stolen.

Blackburn obtained $65 from a pawnshop for the stolen trimmer, and was charged with fraud. He was placed on house arrest as part of his bond agreement, and absconded in November 2006.

Misdemeanors

During the last six months of 2006, Blackburn was arrested for possession of drug paraphernalia, two counts of misdemeanor breaking and entering, two counts of injury to property, communicating threats, and three counts of resisting an officer.

Blackburn was caught and jailed on Dec. 12, 2006 during a wild chase by Tabor City police that began in Soles� law office building. The suspect ran to the area of Tabor Villa Apartments near the South Carolina line along N.C. 410, and hid in thick woods.

Three officers waded into a large briar patch and caught Blackburn. His probation was revoked two days later, and the next day, Dec. 15, he pleaded to the pending break-in, theft and fraud charges and a term of six to eight months was added to the time for the probation revocation.

Another case

Another 120 days was added for the multiple misdemeanor counts in his plea arrangement, records show.

In addition to all this activity surrounding Soles, the SBI is investigating a case of arson to the home of Allen Wayne �Frog� Strickland, a 17-year-old former client and friend of Soles, that took place in late July in Tabor City.

Strickland and family members built the small home with funds he said he was given by Soles. Reports indicate a possible arrest within the next few days in the arson case.

Strickland himself faces an arson charge for the September 2008 fire that damaged the home of the late J.C. Phipps of Tabor City, father of one of Soles� law partners, Bill Phipps, who left the firm in January.

Don't you know that's always the way? Scum like you and I aren't intelligent or responsible enough to safely handle firearms. Hell, we might get drunk one night and hold up a 7-11 to buy some more malt liquor with. Or we might accidentally shoot our spouse or kids while playing "quick draw" with our XDs or 1911s. Geez, the mischief we could get into with these dangerous firearms is limited only to our neanderthal imaginations.

But these elitists, like Feinstein, Rosie O'Donnell and the Honorable Senator here, well, their safety, security, and survival is much more important than some silly law. Laws are for, well, people like us, who wouldn't know how to act if there weren't any laws. These folks know what they're doing - after all, they're waaayyyy smarter than we are....
